Quit School Challenge: Terms and Conditions

  1. The Quit School Challenge is run by Cancer Council Victoria (ABN 61 426 486 715), trading as Cancer Council Victoria (‘Promoter’) of 200 Victoria Parade, East Melbourne VIC 3002.
  2. The Quit School Challenge (‘Promotion’) is a promotion that seeks to encourage Victorian high schools to share submissions of ‘Seeing Through the Haze’ student designed campaigns that best promote smoke and vape-free environments in schools through the Quit website (www.vapingfacts.org.au/for-schools/school-challenge) (‘Submissions’).
  3. Information on how to enter and the details of all prizes form part of these terms and conditions. Participation in this promotion is deemed acceptance of these terms and conditions.
  4. Employees (and their immediate families) of the Promoter and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
  5. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, profession, place of practice and place of residence). In addition, the Promoter reserves the right to request the winner to provide proof of identity and proof of profession. Identification considered suitable for verification is at the discretion of the Promoter.
  6. The Promoter reserves the right, absolutely, to disqualify any entrant who submits an entry that the Promoter considers is not in accordance with these terms and conditions.
  7. The Promotion commences at 8:30AM AEST on 20/03/2024 and final entries close at 15:00PM AEST on 07/10/2024 (‘Promotional Period’). To enter and ensure eligibility, each Submission:
    1. must be submitted to the Promoter by a staff member or manager of a Victorian school;
    2. must be submitted during the Promotional Period and include valid contact details;
    3. must have been marked by an appropriate staff member in accordance with the ‘task marking rubric’ provided in the Seeing Through the Haze classroom resource located on the Quit website (www.vapingfacts.org.au/for-schools/student-workbooks-and-companion-teacher-guides), with the two highest marked campaigns per year level category being submitted.
  8. Schools are encouraged to submit two entries from each of year level 7/8 and year level 9/10 (being a total of four submissions per school). Schools will be limited to a maximum of four Submissions per school. If a school submits more than four entries, the first two Submissions for each year level category will be the eligible entries.
  9. The promotional flow, prize, the relevant start and close times for prize draw are outlined below. The winners and finalists will be announced via electronic direct mail.

Prizes:

A winning Submission will be selected from each of year level 7/8 and year level 9/10. The winners will each receive a $100 Teen gift card (tobacco, alcohol, phone card, other gift card products excluded), the opportunity to collaborate with the Quit social media team to amplify the winning campaign and a letter of recognition to the relevant school co-signed by the Promotor and VicHealth.

In addition to the overall winners, two finalist Submissions will be selected from each of year level 7/8 and year level 9/10 (four finalists in total). Finalists will each receive a $50 Teen gift card and a letter of recognition to the relevant school co-signed by the Promotor and VicHealth.

Entries start: 20/03/2024 at 08:30 AM AEST.

Entries close: 07/10/2024 at 15:00 PM AEST.

Judge: All Submissions received in the Promotional Period will be assessed by a judging panel made up of Quit and representatives from VicHealth.

  1. If any prize (or part of any prize) is unavailable for any reason, the Promoter, in its absolute discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal or comparable value and/or specification. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash. On-selling of prizes is not permitted.
  2. Winners and finalists will be notified via email within twenty-three (23) days of the Promotional Period end date, specified above.
  3. Contact information provided will be used in accordance with Cancer Council Victoria’s privacy policy and for the purposes of drawing a prize winner and finalists and sending out important updates and newsletter via email, unless the entrants opt-out of receiving these email communications from Cancer Council Victoria.
  4. By making a Submission, entrants confirm they consent to:
    1. the entrant and any individuals named within the Submission participating in the Promotion; and
    2. the personal information of the entrant and any individuals’ names within the Submission being used for the purposes of the Promotion, and have obtained consent from such individuals to do so.
  5. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to request and obtain proof of the identity of the entrant.
  6. This is a game of skill, and entries will be drawn based on the Promotor’s discretion as to which design campaign best promotes smoke and vape-free environments in schools. Chance plays no part in determining the winner and finalists. Submissions will be individually judged based on creative merit.
  7. The Promoter’s decision is final and no correspondence will be entered into.
  8. When an entrant submits any materials (including the Submission) via the Promotion website or otherwise, including comments, photos and images (“Content”), intellectual property subsisting in the Content vests in the Promoter and the Promoter may use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights, including in respect of any individuals who have contributed to the Content.
  9. Entrants warrant and agree that:
    1. they will not use cigarettes, e-cigarettes, or vapes as props in the Content or Submissions;
    2. they will not submit any Content that is unlawful or fraudulent, or that breaches any intellectual property, privacy, publicity or other rights of any person, or is defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin, sexual orientation, disability or gender, or is otherwise unsuitable for publication;
    3. they will obtain full prior consent from any person who has created, jointly created, contributed to, or has any rights in the Content, to the uses and terms herein;
    4. their Content shall not contain viruses or cause injury or harm to any person or entity; and
    5. they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems in Australia.
  10. The Promoter may remove any Content without notice for any reason whatsoever, including where content is objectionable in the ways described in para 18 above.
  11. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, natural disaster, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to modify, suspend, terminate or cancel the promotion. Notice of cancellation will be communicated via email to all entrants and also via the Promotion website page.
  12. Any cost associated with accessing the Promotion website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  13. Without limiting any other terms herein, the entrant agrees to indemnify the Promoter in respect of any loss incurred as a result of the entrant’s breach of any of the above terms.
  14. To the extent permitted by law, the Promoter is not responsible or liable for loss to any person that arises out of:
    1. purported Submissions that are not received for any reason whatsoever;
    2. the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any website;
    3. unauthorised human intervention in any part of the Submission;
    4. any damage to persons or property, including to the participant's or any other person's computer related to, or resulting from, participation or downloading any materials in the Submission;
    5. Injury or loss sustained to any persons or property in the course of participating in any activity won as a prize.
  15. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
